An anti-discrimination officer meets with a Chinese-speaking customer about a complaint concerning an interaction at a bookshop.

  1. Officer · turn 1

Good morning, sir. Sorry to keep you waiting. I had a few documents to finish processing. Please take a seat. I understand you've come here because you'd like to make a complaint about racial discrimination. Before we decide whether discrimination may have occurred, I'd like to hear exactly what happened in your own words.

  2. Customer · turn 2

That’s all right. Yesterday morning, I went to a bookshop to buy an English storybook for my newborn niece. However, as soon as I entered the shop, a staff member looked at me and said, “We only have English books here.”

  3. Officer · turn 3

How did you interpret that comment? Do you believe the staff member was referring to your race or ethnic background? We need to establish that before we can determine whether there may have been a breach of the Anti-Discrimination Act.

  4. Customer · turn 4

I believe he said that because of my race. There were other customers in the shop at the time, but he made that comment only to me. He simply assumed that I must have been looking for books in another language and that someone who looks Asian couldn’t speak English. Isn’t that racial prejudice?

  5. Officer · turn 5

Did you ask the staff member what they meant by that, or why they made that comment? It's important that we understand exactly what was said and how the conversation unfolded before reaching any conclusions.

  6. Customer · turn 6

Of course I asked. I said, “What do you mean by that?” However, he didn’t answer me at all and merely looked at me impatiently. I then asked whether he was discriminating against me. He immediately told me to leave and said that, if I didn’t go, he would call security.

  7. Officer · turn 7

Were there any witnesses who saw or heard what happened? For example, were there any customers or other staff members nearby who might be able to support your account of the incident?

  8. Customer · turn 8

There were several customers in the shop at the time, and another staff member was at the checkout, but I didn’t speak to them. It was also my first time visiting that shop, so I didn’t know anyone there.

  9. Officer · turn 9

I see. Well, it's crucial to establish that you were the subject of racially motivated discrimination. However, based on your statement alone, we don't yet have enough evidence to prove that. It would certainly help if we could identify and contact any witnesses, or if you knew of anyone else who had experienced something similar at that shop.

  10. Customer · turn 10

I genuinely don’t know anyone else, nor do I know whether anybody has experienced the same thing. However, I believe the shop should have CCTV, and I hope it can prove that everything I’ve said is true.

  11. Officer · turn 11

That's a good point. We'll certainly look into whether CCTV footage is available. Although the lack of witnesses makes the investigation more challenging, it doesn't necessarily mean there's nothing we can do. Based on what you've told me, the shop assistant's behaviour may have been racially motivated. We can contact the shop owner or employer to obtain more information about the staff member and investigate the matter further.

  12. Customer · turn 12

If necessary, I’m willing to provide any information and cooperate with the investigation. I only hope that nobody else will be treated this way because of their appearance or race.

  13. Officer · turn 13

Thank you. I'll record your statement today and open a case file. We may contact you again if we need further information. Depending on the outcome of our initial enquiries, the matter may be referred to conciliation before any further legal action is considered.

  14. Customer · turn 14

All right. Please handle it as you think appropriate. I genuinely don’t understand how this sort of rubbish can still occur in a multicultural country such as Australia. I only hope the matter will be handled fairly and that nobody else will have the same experience.

  15. Officer · turn 15

I understand why you're upset, and we'll handle your complaint as fairly and objectively as possible. We'll keep you informed of any progress, and if additional evidence becomes available, we'll take that into account during our investigation.
